Terms and Conditions
For all purposes within this document, "Site" or "the Site" refers to the HomeWorkforce web site(s) located at homeworkforce.com.au and other Internet locations. "You", "User" and "Users" refers to any individual, group of individuals, or commercial entity accessing or using the Site.
The Site is owned and operated by Home Channel Pty Ltd ("Home Channel"). From time to time Home Channel may assign certain operational responsibilities to employees or third parties. This in no way alters any rights or responsibilities Home Channel and Users of the Site have under this document.
Your continued use of the Site is deemed to be an acceptance and compliance with the terms and conditions contained in this document (the "Terms") and/or elsewhere on the Site. Home Channel reserves the right to amend the Terms and other conditions of use at any time without notifying Users. As such, you should check for changes to the Terms from time to time.
The Site is an Internet service for posting, searching and browsing classified employment advertisements, posting company and personal profile information (including Resumes), facilitating interaction between Employers and employment agencies ("Employers") and individuals seeking employment ("Job Seekers"), and related services.
General Terms of Use
All information ("Content"), including but not limited to text and graphics, located on the Site, unless specifically stated otherwise on the Site or here in the Terms, is Copyright or Trademark Home Channel, and is protected by Australian and international copyright and trademark laws. You must not modify, copy, reproduce, frame, transmit or distribute this information in any form, with exception to the following:
1. To the extent that is necessary to a) if you are an Internet Service Provider, supply the Content to your subscribers ; or b) if you are an Internet User, download the Content using an industry standard Internet browser.
2. For advertising and/or review purposes, provided that a) you provide advance copies of such materials to Home Channel, and Home Channel does not object to the proposed usage; or b) you obtain a written or verbal waiver from Home Channel expressly stating that you are allowed to make use of the Content.
3. Where it is expressly stated on the Site that you may make use of certain Content.
Users are prohibited from violating or attempting to violate the security of the Site, including without limitation, accessing data not intended for such User, logging into an account which the User is not authorised to access, attempting to breach security or authentication measures without proper authorisation, transmitting computer viruses or worms, overloading, "flooding", "spamming", "DOSing" or "crashing" the Site or related networks. Violations of system or network security may result in civil and/or criminal liability. Home Channel will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.
In order to ensure a safe and effective experience for all of our customers, Home Channel reserves the right to limit the amount of data (including resume views) that may be accessed by You in any given time period. These limits may be amended in Home Channel’s sole discretion from time to time.
Posting employment advertisements, stored resumes and other features of the Site may be used only for lawful purposes by Job Seekers and Employers. Any contact between Job Seekers and Employers facilitated by the Site may only be for lawful purposes by individuals to network for personal or professional purposes with other individuals.
You must not use the Site in any manner or for any purpose that is unlawful or prohibited by the Terms, or in any way violates any right of Home Channel, its members, employees, affiliated entities or other Users of the Site.
Privacy and Security
Home Channel suggests that you also review our Privacy Statement for information on how we aim to protect your private and sensitive information.
Users must exercise caution when using private, sensitive or confidential information provided by other Users, and must abide by all applicable privacy laws.
The Site may contain links to Internet sites operated by third parties. These linked sites are not under the control of Home Channel, and Home Channel is not responsible for the contents of such sites. These links are provided as a part of advertising campaigns and/or as a convenience to Users of the Site. In some instances, advertisements may contain representations by the third party advertiser. Such representations are not made or endorsed by Home Channel, and the third party advertiser is solely responsible for fulfilment of these representations.
Under no circumstances (including but not limited to any act or omission on the part of Home Channel) will Home Channel, its employees, members or affiliated entities be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access, the Site or any Content. Home Channel does not exclude any non-excludable rights that Users may have under Australian State, Territory and Federal Legislation, but does exclude any and all conditions and warranties implied by any other custom, law or statute.
